In most divorce cases, only one parent is granted custody of their children. Situations when an Indiana court may award grandparent visitation:
- If either of the child’s parents is deceased.
- If the child’s parents’ marriage has been terminated.
- If the child was born out of wedlock.
- If a grandparent has attempted to have meaningful contact with the grandchild.
However, grandparent visitation laws do not guarantee that the grandparents will obtain a court order granting them visitation. Instead, the law only gives you the opportunity to request a court order. That is why it is important to get the best legal representation in such cases. Yet, some critics say that these laws violate a parent’s basic right to raise their child in the manner they see fit, including the right to determine the people that their child will be allow to associate with.
The bond between a grandparent and a grandchild should not have to suffer because of the fault of others. The decision to end such a vital relationship should only be made by the grandchild or the grandparent. It is important that a child has the opportunity to have contact with their relatives.
